TERMS & CONDITIONS

These Terms govern your use of the Builders Forge™ website and services operated by Small Project Services LLC (“SPS,” “Builders Forge,” “we,” “us,” or “our”). By using the website, ordering a product, opening an account, subscribing to a service, or approving a project, you agree to these Terms. A signed proposal, statement of work, order form, or separate written agreement may add to or replace these Terms for that specific engagement.

Services

Builders Forge provides practical digital solutions for small and growing businesses across industries. Services may include custom website design or redesign, SEO foundations, custom business tools, web applications, workflow automation, customer portals, scheduling and booking tools, estimate and quote systems, setup, configuration, consulting, hosted tools, software subscriptions, ready-made digital products, ongoing support, and business-management workspaces. We do not promise unlimited custom development or any feature not included in an agreed scope.

Project scope and changes

Custom work is limited to the scope, deliverables, assumptions, timeline, and revisions stated in the applicable proposal or agreement. New features, redesigns, integrations, content work, data migration, revisions, or requests outside that scope may require a written change, additional fees, and a revised timeline. Estimates and timelines are good-faith planning tools, not guarantees, unless a separate written agreement expressly says otherwise.

Client responsibilities

Clients are responsible for providing accurate business information, workflows, content, pricing rules, branding, access credentials, files, approvals, and timely feedback needed for the work. For a custom system to fit a business, the client must accurately explain the current process, required information, decisions, users, examples, and edge cases. Builders Forge cannot guarantee that a custom tool will match an internal process that was not accurately described or provided during the project.

Revisions and acceptance

Reasonable revisions are included only to the extent stated in the applicable proposal or agreement. Major changes, repeated redesign requests, or changes after approval may be billed separately. Clients should review working versions and promptly report issues that materially differ from the agreed scope. A project, feature, or deliverable may be treated as accepted when the client approves it in writing, uses it publicly or commercially, or does not respond to a reasonable review request within the time stated in the project agreement.

Payments, deposits, and fees

Deposits reserve development time and work does not begin until the required deposit is paid. Custom-project balances, milestone payments, recurring fees, taxes, and applicable third-party processing fees are due as stated in the applicable proposal, invoice, checkout page, or subscription terms. Late or unpaid amounts may pause work, delay launch or delivery, suspend access, or require reasonable collection efforts. Payments are processed through third-party payment providers; Builders Forge does not store full payment-card details.

Subscriptions, hosting, and access

Hosted tools, support plans, and software subscriptions renew on the schedule shown at checkout or in the applicable agreement until canceled. Clients may cancel future renewal through the stated account, billing portal, or support process; cancellation does not undo amounts already due or paid for the current period. We may suspend or limit access for nonpayment, misuse, security concerns, or when reasonably necessary to protect the service. Hosting, domains, support, and third-party services may have separate costs, renewal dates, and cancellation rules.

Software, digital products, and platform tools

Builders Forge products may include business workspaces, downloadable products, templates, calculators, estimators, quote and invoice tools, widgets, forms, portals, scheduling tools, hosted software, and other ready-made or custom digital systems. Some products are designed for contractors or trade businesses, while others may be used by businesses in different industries. Product pages, checkout terms, and written agreements describe current pricing, included features, delivery method, setup, intended use, and whether customization is included. Digital products and activated software access are generally nonrefundable after delivery or activation except where required by law or where a written product-specific policy says otherwise. Private delivery links and licensed access are for the purchaser and its authorized users and may not be resold, shared publicly, copied, reverse engineered, or redistributed without written permission.

Custom software and maintenance

Custom tools are built from the requirements and workflows supplied by the client. Clients are responsible for testing the agreed working version with realistic information and reporting reproducible issues. No software, website, automation, or integration can be guaranteed flawless, uninterrupted, compatible with every device or browser, or free from all defects. Unless ongoing maintenance is expressly included, post-launch updates, compatibility work, feature additions, data changes, and new integrations may require a separate agreement or support plan.

Third-party services

Projects may rely on independent services such as Stripe, Supabase, hosting providers, domain registrars, email services, analytics providers, APIs, plugins, app stores, and other platforms. Those services are governed by their own terms, policies, pricing, and availability. Builders Forge is not responsible for their outages, service disruptions, data loss, security incidents, policy changes, feature changes, price changes, account restrictions, or discontinued integrations. We may recommend or help configure a third-party service, but the client remains responsible for reviewing and accepting that provider's terms.

SEO and marketing results

SEO services may improve a website's technical foundation, structure, content, local relevance, and search-readiness. Search engines, advertising platforms, competitors, market conditions, and customer behavior are outside Builders Forge's control. We do not guarantee rankings, traffic, leads, revenue, indexing, or any particular position in Google or another search engine.

Business guidance and results

Builders Forge may help implement websites, software, workflows, SEO, AEO, GEO, automation, and other practical guidelines that we reasonably believe may support a business. This assistance is not a promise or guarantee of business success, profitability, sales, customer growth, visibility, efficiency, or any other result. No strategy, website, tool, recommendation, or system is guaranteed to work completely, continuously, or exactly as expected in every business or circumstance. Results depend on factors outside our control, including the client's decisions, implementation, operations, market, competition, customers, pricing, content, and continued use. Each client remains solely responsible for operating the business, evaluating recommendations, making business decisions, complying with applicable requirements, and deciding whether a product, service, or strategy is appropriate for the business.

Client content, intellectual property, and portfolio rights

Clients retain rights to content, business information, trademarks, and materials they provide, and represent that they have permission to use them. Builders Forge retains all rights in its pre-existing materials, reusable components, frameworks, templates, processes, platform code, subscription products, and general know-how. Ownership or licensing of custom deliverables is governed by the applicable written agreement and is not transferred merely because a project is discussed, designed, or paid for. Licensed third-party fonts, images, plugins, and services remain subject to their own licenses. Unless confidentiality is requested in writing before publication, Builders Forge may display completed public work, screenshots, project descriptions, and the client's name or logo in its portfolio and marketing materials.

Data and security

We use reasonable safeguards appropriate to the service, but no website, software system, transmission, account, or storage method can be guaranteed completely secure. Clients are responsible for lawful collection, use, disclosure, retention, and protection of their own customer, employee, and business data, including obtaining needed permissions and notices. Clients should maintain appropriate backups and protect their credentials, devices, and account access.

Independent businesses and directory listings

Builders and contractors listed through Builders Forge are independent businesses, not SPS employees, agents, partners, representatives, or subcontractors. Directory listings are informational only and do not mean SPS selected, screened, verified, recommended, or endorsed a business. Customers are solely responsible for choosing and evaluating any business before hiring it, including confirming current credentials, licensing, insurance, references, permits, pricing, contract terms, and suitability. Display of a business, contact information, or license number is not a guarantee, endorsement, or continuing verification.

Calculators, estimates, quotes, invoices, and pricing tools

All calculations and documents produced through a Builders Forge product depend on the information, measurements, rates, formulas, settings, taxes, fees, descriptions, and selections entered or approved by the user. Outputs may contain errors, omit costs, become outdated, or differ from actual labor, materials, market prices, taxes, site conditions, customer needs, scope changes, or final results. Builders Forge does not independently inspect a project, verify user-entered information, set a client's prices, or determine whether an output is complete or suitable for a particular transaction.

Users must independently review and verify every calculation, price, quantity, estimate, quote, invoice, proposal, schedule, and customer-facing document before relying on it, purchasing materials, committing labor, sending it to another person, or entering an agreement. Software-generated outputs are planning and administrative aids only. They are not professional advice, appraisals, guaranteed prices, binding offers, or contracts unless the appropriate parties independently review and intentionally adopt them in a final written agreement. The user is responsible for corrections, approvals, pricing decisions, contractual terms, and losses arising from inaccurate or incomplete user information or unverified output.

Acceptable use and availability

You agree to provide accurate information, use our services lawfully, protect account access, and promptly notify us of suspected unauthorized access. You may not interfere with the service, attempt to access another user's records, submit unlawful or deceptive content, scrape the website, infringe another person's rights, or use the service to send spam. We may approve, deny, suspend, or terminate access when reasonably necessary to protect the service, users, or our legal interests. We may change or discontinue features and do not promise uninterrupted or error-free availability.

Termination

Either party may end a custom engagement as allowed by its written agreement. If a project ends early, the client remains responsible for payment for completed work, committed third-party costs, and any nonrefundable deposit or milestone amount stated in the agreement. Upon termination or account suspension, access to hosted services may end or be limited. Where practical and permitted, we may provide a reasonable opportunity to export client-provided data, but the client remains responsible for maintaining its own backups and timely transition planning.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the website, products, and services are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, security, availability, or results. Builders Forge is not liable for client content; user-entered data; unverified calculations or documents; pricing, quoting, estimating, invoicing, purchasing, staffing, scheduling, or business decisions; customer or independent-business conduct; work performed by others; lost profits, revenue, savings, opportunities, customers, or data; property damage; delays; disputes; pricing differences; or third-party service failures.

To the fullest extent permitted by law, SPS will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. SPS's total aggregate liability arising from or relating to a product, subscription, project, or service will not exceed the amount the claimant paid SPS for the specific product or service giving rise to the claim during the twelve months before the event giving rise to liability. For a one-time product, the limit is the purchase price paid for that product. These limitations apply regardless of the legal theory asserted and even if a remedy fails of its essential purpose. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Indemnity

To the extent permitted by law, business users agree to defend, indemnify, and hold SPS harmless from third-party claims arising from their content, services, customer dealings, prices, estimates, quotes, invoices, contracts, use of unverified software output, legal violations, data practices, or breach of these Terms.

South Carolina law

These Terms are governed by South Carolina law, without regard to conflict-of-law rules. Any dispute shall be brought in a court with appropriate jurisdiction serving Spartanburg County, South Carolina, unless applicable law requires otherwise.

Changes and contact

We may update these Terms by posting a revised version and date. Continued use after a change means acceptance to the extent permitted by law.
